Solicitors have expresses two concerns about the SRA's new regime of Outcomes Focused Regulation ('OFR'):-
It lacks certainty: the regulator can make retrospective, subjective judgments as to whether its compliance requirements have been satisifed.
It places compliance officers in an invidious position, exposing them to personal retribution from the SRA for the firm's shortcomings, and creating a barrier between them and their colleagues.
